When you book accommodations or services at Odyssea Escapes (also known as Villa Odyssea), you agree to the following terms and conditions. Please read our terms and conditions carefully before making your reservation. A valid credit card is required to guarantee a reservation. This guarantee may be made confidentially by secure server at the time of making a reservation.
By completing your reservation, you agree to accept the conditions and charges associated with the rate you have selected and the terms and conditions for use of this website. Please see our Privacy Statement for information on our data collection and usage practices.
PRIVACY NOTICE
Guest safety is the most important thing for us. It is committed to protecting your privacy, the confidentiality and security of personal information you provide to us. The information you provide is necessary to process and confirm your reservation; and may include collecting this information in a personal profile. We may also collect information to allow us to properly process the account payments.
The information you provide to us may be used to:
– Contact you if there is a change to your reservation
– Create a profile to help with further reservations you make
– To notify you by email, if you have consented to it when registering on our site, about our special offers and promotions that may be relevant to you.
The information you provided may be disclosed to other parties who have a contractual relationship with the Villas such as banks and service providers. Odyssea Escapes may have legal obligations required by law to disclose information you provided to the hotel.
RESERVATION PROCEDURE
Reservations have to be made in writing, either by filling out the reservation form available on our websites or by writing other correspondence such as email or text. Follow the step-by-step instructions below to make your reservation.
– Fill in the form completely if you are making reservation through website reservation form. If you are making your reservation through other means of written communication, please provide detailed information including number of persons arriving along with thier age.
– Detailed information regarding the number of persons including their age is required prior to accepting your reservation.
Unless explicitly stated, the capacity of each suite is two adults per bedroom. Please let us know if you are expecting any additional guests and we can seek to accommodate such and provide additional bedding, with express permission, prior to arrival.
Our reservation officer will respond to your inquiry within 24 hours. If you do not receive any response from our side after 24 hours, please contact us immediately via the following email address:info@villaodyssea.com
If the inquired Villa is available (Odyssea House or both Odyssea House and Odyssea Oasis), you will receive a response with detailed information about the suite, its rates for the inquired period, and further instruction for completing your reservation.
Availability may change at any time, especially during peak and high seasons. Suites available at the time of contact for questions may no longer be available when you decide to confirm your reservation. It is therefore advisable to confirm your reservation as soon as you receive the availability information.
Make sure to settle the payment upon reserving. Your reservation will be automatically declined if the payment attempt failed.
When we receive the payment, we will issue a payment receipt along with booking confirmation containing related information to your reservation including check-in and check-out date, exclusions and inclusions, etc.
For exact pick-up arrangement, please provide detail of the arrival schedule of each member of your group. You will be assigned a personal concierge upon booking who will attend a meet and greet and accompany you/ group to the location.
CONFIRMED BOOKINGS
All bookings are held in good faith for the arrival to the departure dates listed in the reservation system, at the rate determined at the time of booking. Full payment for your booking must be received by Odyssea Escapes on the date of booking. Reservation is confirmed with valid credit card accepted. You undertake that you are of legal age; that all details you provide as part of the booking process, payment process or any purchase on this website are correct; that the credit card used is your own; and that there are sufficient funds to cover the cost of the accommodations and other products & services. Reservations can be cancelled if any of the above conditions can’t be met and verified.
PACKAGE DEALS, ADD-ONS AND PROMOS
These are offered from time to time and are subject to further terms and conditions which may or may not be detailed on the website. These terms and conditions can be confirmed by contacting hotel Reservations prior to booking. Booking for these packages implies acceptance of all additional special terms and conditions. Any and all package offers, add-ons and promos may be withdrawn at any time without notice. Package offer orders, add-on & promo purchases are non-refundable, non-exchangeable and non-transferable.
PAYMENT
A deposit of 100% of the total amount due for rent (“Deposit”) must be received by Odyssea Escapes within two (2) business days from the date the guest is issued the relevant invoice and payment instructions for bookings made outside of villaodyssea.com
If the Deposit is not paid as required, the booking will not be completed and the booking will be considered cancelled.
Payment through our website villaodyssea.com is due in full upon booking.
VILLA RATE AND PRICE
The most accurate source of our official rates and prices can be found on our official website; www.villaodyssea.com, and also by calling our Reservation centre directly at +1 284 442 2208 (BVI office hours: 9am – 5pm).
Rates and price information from these sources are the best prices that can be applied to the Villas and or other services provided by Odyssea Escapes.
All prices, including special price offers provided to you on a case-by-case basis (via website, email or telephone) always have limited validation. A confirmed and paid order must be made to claim the offer before it expires.
AMENDMENTS OR CANCELLATION/NO SHOW POLICY
Guest must request any changes or cancellations in writing by email to info@villaodyssea.com The email must clearly state the booking date, name, and booking number. The Reservation Agent will make every effort to accommodate any requests for changes but the final decision will be made by management. Should we be able to rebook the dates cancelled we will issue a refund, less any bank fees.
REFUNDS FOR CREDIT CARD
Refunds for Credit Card Payments will be made after payment is completed and after the bank declares that there are no irregularities in the transaction. “Shorten Stay” & “No Show” for confirmed bookings will not be refunded. For group or corporate bookings, cancellations can be confirmed with the Property Manager by an authorized representative of the group, or the person making the reservation.
FORCE MAJUERE
Odyssea Escapes is not responsible for booking cancellations and shortened stays due to force majeure/acts of God or conditions beyond the villa’s control, including floods, earthquakes, explosions, fires, civil disobedience, war, epidemics/pandemics, laws not effective as of the date of this agreement, labor dispute or third-party suspension. In addition, Odyssea Escapes will not be liable for any failure to perform its arrangements and other obligations under the same circumstances. In such cases, Odyssea Escapes must be given a reasonable extension of time to perform obligations or arrangements.
Rescheduling (rebooking) or other arrangements may, at Odyssea Escapes sole discretion, be considered without a rebooking fee, but subject to availability and within six (6) months from the time of booking. Rates at the time of booking will apply, but if the schedule is to be changed from a lean period to a peak period, the price difference will be collected.
SECURITY DEPOSIT FOR ANY DAMAGES & LOSES
A valid security deposit for unexpected expenses of USD 500 is required upon check-in. This can be done by cash or credit card and will be refunded upon inspection of the villa upon check out. If any damage or damage occurs to the suite due to the guest’s actions, intentional or not, then we ask you to report it to the property manager so that we can repair the damage as soon as possible and we reserve the right to add the cost of replacing or repairing items to the guest’s bill at check out. For the avoidance of doubt damage/damage includes, but is not limited to, permanent stains, cigarette burns, rips, scratches or other damage to furniture and soft furnishings. Failure to provide a security deposit may result in the rejection of the reservation, without a refund.
PROPERTY DAMAGES Provided there is no breakage, damage, missing items, no additional cleaning for villas left abnormally dirty, and no other outstanding charges incurred before, during or after your stay. All normal utilities (except for careless or extremely excessive use of your villa’s water supply) are included in your rental price. You hereby agree to pay to us on behalf of the owner of your villa the cleaning or replacement costs for all damages to personal property. Locked pantries and closets are reserved for the use of the villa owner and are not included in this rental. You as the Guest agree to take all reasonable steps to ensure that your family and other guests in your party adhere to the rules and regulations governing your use of the villa. All villas are privately owned, so decor, colours and inventories will of course vary. All villas are fully furnished, including an ample supply of bed linens and towels for Guests’ use. Rearranging the furniture or removing any items from the villa is prohibited.
ARRIVAL / DEPARTURE TIMES
– Check in time is 16.00pm
– Check out time is 10.00am
If the check-out time is different from the times above, additional fees may apply. This fee will vary depending on the additional time required and needs to be confirmed at the time of booking.
RESPONSIBILITY
Please note that we are not responsible for any loss or damage to personal equipment and property during your stay at Odyssea Escapes or during your participation in any activities during your visit to the British Virgin Islands. We will not be responsible for any delays, additional costs or inconveniences that may be caused directly or indirectly by events beyond our control such as delays in arrival of International flights, civil disturbances, fires, floods, unusually bad weather, God’s destiny, Government actions, or failure of any machine or equipment.
SWIMMING POOL and ROOFTOP AREA
Use of the pool is at the guest’s own risk. No glasses of any kind allowed in the pool/jaccuzi area.
SMOKING POLICY
Smoking is not permitted anywhere in the villa. However, guests can smoke outside the villa/ parking area. Ashtrays are provided for guests’ use upon request.
If guest is found smoking inside the villa, the full security deposit will be forfeited to cover the cost of cleaning the Air Conditioning System and fumigating the furniture, etc. Odyssea Escapes management reserves the right to pursue the main guest for any additional costs as a result of having to move future guests while the villa is being cleaned and fumigated.
MAID SERVICE
The Villa will be cleaned before your arrival and thereafter will be provided once per week.
CHILDREN
Children and Infants are welcome. Please let us know in advance of any special requirements. We advise Guests to pay particular attention to children who may be in their party so as to avoid injury or harm as some locations have high balconies etc. that can pose problems to unsupervised minors. Neither the owner, BPP Sales and Rentals Ltd. or any of their employees is not liable for any personal injury occasioned to children as a result of the negligence of either, the child, the Guest, or the Owner.
INSECTS & PESTS
Insects and pests are sure to exist in the British Virgin Island’s tropical climate. This is normal and management will take action to eradicate the problem completely. Please contact Odyssea Escapes management as soon as possible if you encounter any problems with insects or pests and they will act accordingly. Failure to promptly report a problem cannot be considered a reason by the guest to claim compensation.
PETS
Pets of any kind are NOT allowed in or within the villa area without express authorisation. Pets, or pet evidence, found on the premises will result in immediate eviction, and the guest’s rent and deposit will be forfeited to cover the costs of professional curtain and furniture cleaning, etc.
ENTERTAINING/ADDITIONAL GUESTS
Parties or functions such as weddings are allowed with advance permission. If a guest is found to have had a group gathering for more persons than stated on this agreement and/or without advance permission by the Property Manager of he/she is subject to a 50% penalty fee (calculated on the TOTAL). Any extra guests invited to the property, please contact the Property Manager for consent.
DRUGS & HAZARDOUS MATERIALS
All guests and members of their entourage are not allowed to use or bring illegal substances, flammable liquids or other explosives or items deemed dangerous to life, limbs or property into the hotel.
LIABILITY
It is highly recommended to get travel insurance which covers any potential loss during your vacation including illness, injury, death, damage, loss and cancellation. Odyssea Escapes is not responsible under any circumstances to replace or return any unused portion of accommodation and other related services.
Odyssea Escapes assumes no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of defects or the acts of any company or persons using the villa. Furthermore, Guests are responsible for their villa during occupancy and must lock villa’s windows and doors securely at all times when not on the premises, and must observe all cautions as given by Property Manager. Neither Odyssea Escapes or any of their employees are liable for any negligence, personal injury, loss or damage to personal property that may be attributable to the Owner. The Owner is not liable for any loss or damage to property.
Odyssea Escapes is not responsible for any damage, loss, injury and death suffered by guests staying both inside and outside the villa.
While we make our best efforts to ensure the accuracy of the information presented on our website, we are not responsible for any changes and alterations made by the management.
Odyssea Escapes is not responsible for the loss and damage to the personal belongings of guests and visiting guests including the car and personal belongings left inside.
OTHERS
We strive to provide a comfortable environment for all our guests. Please note that our villas are located in residential areas and there are relevant noise, section and function restrictions. No party or noise will be accepted at any time unless previously arranged. Please follow these rules to save unfavorable eviction from the villa in case of any complaints.
Governing Law
These Terms and Conditions are covered in all respects by British Virgin Islands
Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the BVI IAC Arbitration Rules.”
The number of arbitrators shall be one;The place of arbitration shall be Road Town, Tortola, British Virgin Islands, unless the Parties agree otherwise. The language to be used in the arbitral proceedings shall be English.
